These terms and conditions set out the rights and responsibilities of anyone using this site. “Ceramic Vibes,” “we,” “us,” or “our” are terms referring to ceramicvibes.co.uk. These t&c's apply only to the website where these t&c's are posted. Your use of our services is also subject to our privacy notice.

 

WE ENCOURAGE YOU TO READ THESE TERMS AND CONDITIONS AND OUR PRIVACY NOTICE IN FULL TO UNDERSTAND OUR T&C'S BEFORE USING OUR SERVICES. BY USING OUR SERVICES, YOU ACKNOWLEDGE YOU HAVE READ AND UNDERSTOOD EVERYTHING DESCRIBED IN THESE TERMS AND CONDITIONS.

Information about us:

We are a ceramic design and printing company set in rural Lincolnshire by owners Chris and Freddie.

 

Contacting us if you are a customer:

To cancel an order in accordance with your legal right to do so, you just need to let us know that you have decided to cancel. The easiest way to do this is to contact the Customer Services team by using our contact page or by calling us on 07480667041. 

If you are emailing us please include details of your order to help us to identify it. If you send us your cancellation notice by e-mail  then your cancellation is effective from the date you send us the e-mail.

 

If you wish to contact us for any other reason, including because you have any complaints, you can contact us by using our contact page or by calling us on 07480667041. 

If we have to contact you or give you notice in writing, we will do so by e-mail you provided to us in your order.

 

Contacting our customers:

Should we need to contact you we will email or write to you as set out in our privacy notice. If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible.

You as a customer:

If you are a customer, you may only purchase products from our site if you are at least 18 years old. If you are underage, please do not attempt to order these products from our site. By placing an order with us you are confirming that you are of legal age to purchase the relevant products. Your access to and use of our website is conditioned on your acceptance of and compliance with these Terms. By accessing or using ceramicvibes.co.uk you agree to be bound by these Terms and any subsequent revisions. If you disagree with any part of the Terms then please do not use this service.

We may not accept or process your order if:

  • if we are unable to get authorisation for your payment

  • we do not receive payment

  • we feel your personalisation request is in breach of copyright law, illegal, obscene, offensive, pornographic or defamatory

  • there has been an error in our pricing or description

  • the ordered items are out of stock

Any content you upload to ceramicvibes.co.uk or email to ceramicvibesltd@gmail.com must be your own or you must own the legal property rights. If your content is a photograph, you must have taken the photograph yourself or own the copyright. 

 

Registration:

By registering with ceramicvibes.co.uk you are:

  • confirming that you are 18 years of age and over

  • agreeing not to create any personalised items intended to infringe copyright or to abuse, intimidate, threaten or harass anyone

  • accepting that you are entering into a contract with Ceramic Vibes

  • agreeing you have fully read and understood both our privacy notice and t&c's

You are not permitted to share your account with another person or group(s). If you believe someone else has taken control of your account please inform us immediately. Your submission of your personal information is governed by our Privacy Notice. 

Our right to vary these terms:

We amend these Terms from time to time. Please look at the top of this page to see when these terms were last updated. Every time you order products from us, the terms in force at the time of your order will apply to the contract between you and us. We may revise these terms as they apply to your order from time to time:

(a)           to reflect changes in relevant laws and regulatory requirements; and/or

(b)           in the event that there is a material change to our relationship with our suppliers.

 

If we have to revise these terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the contract if you are not happy with the changes. You may cancel either in respect of all the affected products or just the products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.

About our products:

We will make every effort to accurately display and describe our products.  Product colours, style, size and weight may vary from the display shown on electronic devices. Packaging may vary from one order to the next. Print files for items like mugs need to have a resolution of 300 DPI because prints are small and often detailed.

How you order from us:

To order a gift from us you are creating a contract between yourself and us. Simply add the items you desire to your cart, once finished view your cart and check your order is correct. If you're adding written content to a design (only applicable on our "personalisable mugs") then please insert this in the "add a note" text box, ensuring spelling is correct. Confirm your order by checking out via PayPal, Mastercard, visa or American express. You will then be asked to pay for your order in full. An order is only complete when your payment details have been submitted and authorised. When your payment has been authorised we will send you an Order Confirmation email with a unique order number for your reference and our reference. If you're adding an image to a design, please email us your image (ensuring the image quality is of 300 DPI or higher). 

 

We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation).  The Contract between us will only be formed when we send you the Dispatch Confirmation.

Payment:

All payments must be made in British Sterling (£). Postage and packing are charged at £3.10 in addition to the price of any goods and are clearly stated before the point of purchase with the exception of any promotional offers. Delivery of an order shall be completed when we deliver the products to the address you gave us and the Products will be your responsibility from that time. You own the Products once we have received payment in full, including all applicable delivery charges. You can pay for our products using a debit or credit card or via PayPal.

 

Postage:

Please be accurate when entering the recipient’s address and be sure to include their postcode. If you enter the delivery address incorrectly we are not liable for gifts that go un-received. Our order process is up to 5 working days. All orders are dispatched within 24 working hours via Royal Mail 2nd class post at £3.10 per order for up to 5 mugs. We are not liable for delays due to extreme weather, postal strikes, bank holidays, peak times – anything out of our control. If you want to send more than 1 package to different address please enter these as separate orders.

 

Order amendments, cancellations, returns and refunds:

If you are a consumer, you have a legal right to cancel a contract within 14 days and claim a refund exercising your right to change your mind (Consumer Contracts Regulations 2013). These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office. Please review your order at every stage and at final confirmation. You are responsible for your orders accuracy. Any photo or content uploaded will be stored on our servers for the purpose of processing and for filling our contract with you. Your order records will be kept indefinitely whilst you have an account with Ceramic Vibes . Up on closing your account the information will be archived and stored for up to 7 years unless requested otherwise. We will not alter any spelling, grammar or punctuation written in the "add a note" section of check out. If you wish to amend an order please contact us during our business hours Monday – Friday 9am to 5pm and we will do our best to meet your requests, however, if an order has already been processed this will not be possible.  If an order is in the process of being or has been printed and/or packed and dispatched then the order cannot be amended or cancelled. If you think our goods are faulty, broken, incomplete or not as described please contact us by email or phone during our business hours Monday – Friday 9am to 5pm and we will work hard to rectify the situation. We may ask you to send us photographs to assist us in resolving the issue. If you are eligible for a refund, you will be reimbursed via the original method of payment. In some cases we may offer you a reprint with free delivery.

You are not eligible for a refund if:

  • The goods are perishable

  • You have provided a photo with a resolution less than 300DPI

  • The seal has been broken on any of the goods

  • The goods have been personalised in any way

  • The goods have been handled to the extent that their value has been degraded

If there is an error with your order on our part, please contact us as soon as possible by email during business hours Monday – Friday 9am to 5pm and we will do our very best to rectify the situation. We have the right to cancel any order at any time. In this instance we will contact you and issue a full refund.

 Intellectual property rights provision:

The contents of these pages (including without limitation all descriptions, images, photographs, designs, pictures, logos, graphics and written text) are the copyright trademark of Ceramic Vibes. The copying, modification, reproduction or incorporation of part or all of the material on this website in any form is prohibited with the sole exception that you may print and download extracts for the purpose of using this website or placing an order with Ceramic Vibes.

Our liability:

 

We only supply the products for domestic, private use unless specified. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession);

  • any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and

  • defective products under the Consumer Protection Act 1987.

 

Promotions:

From time to time, we may choose to run promotions for specific product offers or discount opportunities via our site (Promotional Offers). In addition to the terms set out above applying to purchases of products which are subject to any promotional offers, any description and terms of each promotion set out on our site and in the marketing communication in which the promotional offer was originally supplied upon by us (Promotion Terms) shall also apply.

 

All of our promotional offers are also subject to the following specific terms and conditions:

  • Promotional offers are only valid on full-priced items and cannot be used on sale or promotional items which are already discounted unless otherwise stated,

  • Promotional offers are valid for a limited period of time as specified in the original marketing communication containing the promotional offer and cannot be used outside of that period,

  • If an item from an order which is subject to a promotional offer is returned, and by giving a full refund for such item, the amount spent by you would mean the order value is less than the qualifying spend for that promotional offer, then we may deduct the total discount given under the promotional offer from any refund,

  • All orders are subject to stock availability and we reserve the right to withdraw, amend or extend promotional offers at any time.

 

To the extent that the promotional offer in question involves the supply of a code which can be used to apply a discount if your order meets the terms of the promotional offer (Promotional Code), the following additional terms and conditions apply:

  • Promotional codes cannot be used in conjunction with any other offer unless otherwise stated in the promotion terms,

  • If using the promotional code online, enter it as requested during the check-out process;

  • Promotional codes are for use by the intended recipient only and proof of entitlement to use a promotional code may be requested,

  • All orders using promotional codes are subject to our acceptance and any improper use of promotional codes may result in the cancellation of your order.
